Goni Kinnami v. Bornu reiterated same in Omorhirhi v. Enatewere

Oputa JSC says, “What is the meaning of proof beyond reasonable doubt” used in Section 137 (1) of the Evidence Ac. Proof beyond reasonable doubt do not mean proof beyond shadow of doubt. The law would fail to protect the community both in criminal cases as well as in civil cases if what is required is proof beyond shadow of doubt, if what is required is absolute certainty.
